Court throws out injured Gazan’s claim for damages

Jerusalem, 11 November, 2018 (TPS) -- The Be’er Sheva District court has rejected a lawsuit filed by a Palestinian from Gaza against Israel, in which he attempted to sue the state for damages after being hit by a bullet fired by IDF soldiers in 2014, claiming there had been no operational justification for the troops to open fire
In the lawsuit, the plaintiff claimed that the IDF had opened fire in violation of international humanitarian law, which grants him the right to sue for personal damages. However, the presiding judge brushed that claim aside, as the plaintiff “is the subject of an enemy entity,” and that there is no legal precedent for such a ruling.
